1Accepting these terms
PLEASE READ THESE TERMS CAREFULLY. BY ADDING LUNAR TO A SERVER, SIGNING IN TO THE DASHBOARD, OR USING LUNAR IN ANY WAY, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM. If you are not eligible, or do not agree, you do not have our permission to use Lunar.
You acknowledge and agree that, as these terms set out in more detail: (a) Lunar is provided to you as a service under a limited license, and you get no rights to its software; (b) you may use Lunar only as these terms allow; (c) Lunar is provided "as is", without warranties of any kind, and Moonthia's liability to you is limited; and (d) disputes are governed by Israeli law and go to the competent courts in Israel, without taking away consumer rights that cannot be waived.
Our Privacy Policy explains how we handle data. If you add Lunar to a server, you confirm that you are allowed to add bots to it.
2What Lunar is
Lunar ("Lunar", "we", "us") is a Discord bot and web dashboard owned and operated by Moonthia (moonthia.com), a sole proprietorship in Israel, reachable at [email protected]. Lunar runs on Discord, so Discord's terms also apply to your use of it. We are not affiliated with or endorsed by Discord.
What Lunar does in a server depends on the features that server's admins turn on. Lunar relies on third-party services, including Discord, Anthropic and our payment processors, and we are not responsible for their availability or their terms.
3Who can use it
You must be at least 16 years old to sign in to the dashboard, add Lunar to a server, or manage a server's settings, and you must meet Discord's minimum age for your country where that is higher. You must be at least 18 to buy a plan. While Lunar is in closed beta, anyone can sign in, but Lunar works only in servers whose owner has been given access to the beta.
Server admins decide whether to add Lunar and which features to use, and are responsible for using them in line with these terms and Discord's.
4Closed beta and availability
Lunar is in closed beta. Features may be added, changed, paused or removed, and we do not promise any level of availability or that data will never be lost. We may limit, pause or end all or part of the service. Do not rely on Lunar as the only place you keep important data.
5Your license to use Lunar
We grant you a limited, personal, non-exclusive, non-transferable and revocable permission to use the running Lunar service in the servers where it has been added, for as long as you follow these terms. This gives you no rights to Lunar's source code, design or other materials, which are proprietary. You may not copy, distribute, modify, reverse engineer, resell, sub-license or self-host Lunar or its code, in whole or in part.
6Acceptable use
When using Lunar, you agree not to:
- use it to break the law, Discord's terms, or any other platform's rules;
- abuse, overload, probe or attack the service, or try to gain unauthorized access to it or its data;
- reverse engineer, decompile, scrape or otherwise try to extract Lunar's code or materials;
- resell, redistribute or run Lunar as a service for others without our written permission (using Lunar in your own community, including under your own bot, is allowed);
- use Lunar, its output or any data it provides to train, fine-tune or evaluate AI or machine-learning models;
- use Lunar to harass, harm or deceive others, or to infringe their rights.
Some of these actions may also be offenses under the law, including Israel's Computers Law. Good-faith security research that follows our Security Policy is authorized under that policy and is not a breach of this section.
7Your content and settings
You and your server are responsible for the configuration and content you give Lunar, and you confirm that you have the right to use it and that it does not break the law or any platform's rules. You grant us the permission we need to store and process that content to provide the features you enabled, to correct AI replies reported to us, and to keep the records these terms describe. We may remove content or settings that break these terms.
AI chat. Where a server with a Premium+ plan turns on AI chat, replies are generated by an AI model (Anthropic's Claude), as our Privacy Policy describes. We do not write or review them, they can be wrong, and you should not rely on them for medical, legal, financial or safety decisions. Each AI reply is labeled as AI-generated. The server is responsible for where it allows AI chat and for the instructions it gives it, which cannot override our rules. Report a reply that breaks these terms to [email protected]. We may turn AI chat off for a server that misuses it.
To report content that infringes your rights, write to [email protected]. If you send us suggestions, we may use them without obligation to you.
8Server owners and staff
If you run a server that uses Lunar, you decide which features run there, and you are responsible for telling your members what you turn on where the law or Discord's rules require it.
Lunar keeps a record of actions that staff take in a server through the dashboard and staff commands. Only the server owner can view and export it, and it is kept until the server's data is erased. By acting as staff in a server, you acknowledge that your actions are recorded.
A server can encrypt its logs with a passphrase held by its key holders. We cannot read encrypted data or recover a lost passphrase, and if every key holder loses theirs, the data cannot be recovered.
A server with a Premium+ plan can run Lunar under its own Discord bot. You are responsible for that bot's Discord application and for following Discord's developer terms. We store its token encrypted and use it only to run that bot in your server.
If you create a form, you are responsible for what it asks, for having a lawful reason to ask, and for how you use the answers. Do not ask for passwords, payment card numbers or other secrets.
9Intellectual property
Lunar, including its source code, design, branding and other materials, is the property of Moonthia, all rights reserved, and is provided to you only as a service under the limited permission above. The software is governed by a separate proprietary license. Discord's name and trademarks belong to Discord and are used only to identify the platform Lunar works with.
10Paid plans
During closed beta, Lunar's core and every Premium feature are free for every server, and nothing is for sale. Premium+ features need a Premium+ plan or higher. Plans go on sale when the closed beta ends, and the core stays free. The price, the period, what each plan includes, the total with any tax, and your cancellation rights are shown on the pricing page and again at checkout before you are charged.
Card payments are processed by Polar (polar.sh), which sells the plan to you as merchant of record, so Polar's terms also apply. A plan paid by card renews at the end of each period until you cancel it. You can cancel at any time from your account, and the plan stays active until the end of the period already paid for.
Crypto payments are processed by NOWPayments (nowpayments.io). They buy one period, which does not renew automatically. Prices are in US dollars, and crypto payments are converted at the rate NOWPayments quotes when you pay. An underpayment is credited to your account and applied when the rest is paid. Crypto payments are not offered to consumers who live in the European Union or the European Economic Area. We do not verify the identity or location of anyone who pays in crypto, so by paying in crypto you confirm that you are not such a consumer. If you are, please pay by card.
A plan starts as soon as its payment is confirmed. At checkout you confirm that you are 18 or older, that you agree to these terms, that you want the plan to start immediately, and that once it has started you lose the right to cancel it for a refund within 14 days, except where the law that applies to you gives you that right regardless. If we refund a card purchase in full, the plan ends and its subscription is cancelled. Crypto payments are refunded only where the law requires it, to a wallet you name. When a plan ends, nothing you configured is deleted; the features it unlocked stop applying.
We keep a signed record of each purchase, including the agreement you confirmed at checkout, when and from where you confirmed it, and the payment processor's messages about it, for 12 years, even if your account or the server's data is erased.
11Disclaimer of warranties
LUNAR IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT LUNAR WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY DATA WILL BE PRESERVED. NOTHING IN THIS SECTION REMOVES CONSUMER RIGHTS THAT CANNOT BE WAIVED BY CONTRACT.
12Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, MOONTHIA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF LUNAR OR YOUR INABILITY TO USE IT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. FOR A PLAN YOU PAID FOR, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO WHAT YOU PAID US FOR THAT PLAN IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT THE LAW DOES NOT ALLOW US TO EXCLUDE OR LIMIT, AND NOTHING REMOVES CONSUMER RIGHTS THAT CANNOT BE WAIVED BY CONTRACT.
13Suspension and termination
You can stop using Lunar at any time, and a server admin can remove it from a server at any time. The Privacy Policy explains what happens to a server's data afterward.
During closed beta we may suspend or end access to Lunar for any reason. Once plans are on sale, we will do so only if you break these terms, if the law or Discord's rules require it, or if your use puts the service or others at risk, and we will tell you why and how to appeal at [email protected]. If we end a paid plan for any reason other than your breach, or end the service or a feature a paid plan covers, we will refund the unused part of the plan.
14Governing law
These terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. Any dispute arising under or relating to these terms or to Lunar goes to the competent courts in Israel. If you are a consumer, this does not take away rights that the law of your country of residence gives you and that cannot be waived, including any right to bring a claim in its courts. If any part of these terms cannot be enforced, the rest remains in force. These terms and the Privacy Policy are the entire agreement between you and Moonthia about Lunar.
15Changes
Until the closed beta ends, we may change these terms at any time, and the new version applies from the day it is posted. After the beta, we will post material changes before they apply and email a notice from [email protected] to everyone who asked for notices in their account settings. Mail about these terms from any other domain is not from us. Continuing to use Lunar after a change applies means you accept it.
